The parties shall voluntarily comply with the arbitral award within the time period specified therein. If one party fails to do so, the other party may apply to the competent court for enforcement.
Where the domicile of the Respondent or the location of their property is within China, the applicant may apply to the Intermediate People's Court at theplace of domicile or property location for enforcement. Where the domicile or property is located outside China, and the country concerned is a contracting party to the 1958 United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards(the “New York Convention”), the applicant may apply to the competent court of that country for recognition and enforcement in accordance with the Convention.
When applying to a foreign court for recognition and enforcement of an arbitral award, the applicant shall submit a written application for enforcement together with the original arbitration agreement, the original arbitral award, and certified translations and other supporting documents as required by the court.
The Convention on the Recognition and Enforcement of Foreign Arbitral Awards entered into force for China on April 22, 1987. Arbitral awards rendered by the arbitral commission may be enforced in the courts of all countries or regions that are contracting parties to the New York Convention.
