On September 28, Chongqing Special Event of 2024 China Arbitration Week – In Memory of the 30th Anniversary of the Arbitration Law was successfully held at Southwest University of Political Science and Law. The event was co-hosted by China International Economic and Trade Arbitration Commission (CIETAC) Southwest Sub-commission, Chongqing Arbitration Commission, School of Economic Law of Southwest University of Political Science and Law, and Beijing Hylands (Chongqing) Law Firm, and was strongly supported by Chongqing Municipal Bureau of Justice. Li Yan, Vice President of Southwest University of Political Science and Law, Xu Yanbo, Secretary of the Party Committee and Deputy Secretary General of CIETAC, and Qi Wen, Deputy Director of Chongqing Arbitration Commission, delivered speeches, and Lu Daifu, Dean of the School of Economic Law of Southwest University of Political Science and Law, presided over the opening ceremony.

 

 

Vice President Li Yan said that Southwest University of Political Science and Law, as the important center of legal discipline, has actively participated in arbitration for years and has provided a large number of outstanding talents for the arbitration business. In the future, Southwest University of Political Science and Law will further expand the construction of arbitration law disciplines, strengthen talent cultivation, and contribute to the high-quality development of arbitration.

In the video speech, Secretary Xu Yanbo pointed out that since the establishment, CIETAC has always adhered to serving the country's major strategic, with the goal of building a world-class arbitration institution, constantly summarizing practical experience, improving the quality and efficiency of arbitration services, and effectively meeting the increasingly diverse and professional dispute resolution needs of Chinese and foreign parties. In the future, CIETAC and CIETAC Southwest Sub-Commission are willing to work together with all walks of life to promote the dissemination and innovation of arbitration culture, enhance the credibility of arbitration, and continuously improve the international influence and competitiveness of Chinese arbitration and Chongqing arbitration.

Deputy Director Qi Wen noted that as the leading arbitration institution in the western region, Chongqing Arbitration Commission has continuously promoted innovation and international development in recent years, and will continue to cultivate a world-class team of arbitration practitioners and build the world-class arbitration institution in the future.

In the keynote speech session, Sun Hailong, Vice President of the Chongqing Municipal Higher People's Court, introduced the policy of the people’s courts to support and supervise arbitration, the basic situation and characteristics of the judicial review of commercial arbitration cases in Chongqing people’s courts, and put forward five thoughts and suggestions on how to improve the mechanism of the support and supervision of arbitration. He also mentioned that the Memorandum of Cooperation on Establishing and Improving the Working Mechanism for the Convergence of Litigation and Arbitration signed by the Chongqing Municipal Higher People's Court and CIETAC will provide a fairer and more efficient way to resolve foreign-related commercial disputes.

The first panel discussion on “The Changing Commercial Arbitration: New Measures, New Rules and New Practices”, was chaired by Yang Ming, Deputy Secretary General of CIETAC Southwest Sub-commission. Zhang Zhimin, Deputy Director of the Public Legal Service Management Division of the Chongqing Municipal Bureau of Justice, introduced the Chongqing measures to build the international commercial arbitration center. Qu Zhujun, CIETAC arbitrator and former director of CIETAC working division, gave a detailed interpretation of the key amendments of the 2024 CIETAC Arbitration Rules. He Jing, head of Liangjiang International Arbitration Center, shared the exploration and practice of arbitration internationalization in Chongqing. During the discussion, Zeng Lingjian, Professor of Southwest University of Political Science and Law, shared his understanding on the development of commercial arbitration in the past 30 years based on his experience.

The second topic of the discussion on “New Company Law and Arbitration Practice”, was chaired by Zhang Bo, Vice Dean of the School of Economics and Law at Southwest University of Political Science and Law. Vice President Li Yan discussed the arbitrability of several types of disputes involving company law with the title of “Review of the Arbitrability of Company Disputes from the Perspective of the Rule of Law in the Business Environment”. Zhou Yousu, Vice President of the Commercial Law Research Association of the China Law Society and Professor of the Sichuan Academy of Social Sciences, presented the impact of innovations in company investment and financing system on arbitration practice. Wu Wanli, lawyer from Beijing Hyland (Chongqing) Law Firm, shared the practical issues of lawyers in handling arbitration cases and put forward relevant suggestions. Subsequently, Wang Defan, director of the Company Law Committee of Chongqing Lawyers Association, and Wu Feifei, Associate Professor of the School of Economics and Law of Southwest University of Political Science and Law, had a discussion on arbitration practice in the context of the new Company Law.

The event attracted wide attention in the field of legal services in Chongqing, drawing the participation of hundreds of arbitrators, lawyers, industry experts, teachers and students from universities. In the future, CIETAC and CIETAC Southwest Sub-Commission will continue to uphold integrity and innovation, provide high-quality and convenient arbitration and diversified dispute resolution services for parties in Chongqing and Southwest China, and also continue to contribute to the modernization and internationalization of Chinese arbitration system and to Chongqing's efforts to an international commercial arbitration center.
