On the afternoon of September 24, the seminar "Plan and Move After - Layout and Strategy of Overseas Dispute Settlement of Chinese Enterprises", a series of activities of 2024 China Arbitration Week, was successfully held in Beijing. The seminar was directed by China International Economic and Trade Arbitration Commission (CIETAC), hosted by Allen & Overy Law Firm and co-organized by Dow Jones. Wang Qingyou, Director of Allen & Overy Law Firm, and Huang Ningning, Vice President of Shanghai Lawyers Association and Partner of Guohao Law Firm (Shanghai), delivered opening speeches respectively.

The seminar has four sessions. In the first session, Bi Liyan, Director of the Legal Department ofChina Metallurgical Group Corporation, gave a keynote speech on "New Concerns and New Responses to Overseas Investment"; The second session was chaired by Liu Jiong, Partner of Allen & Overy Law Firm, Li Ying, head of litigation of Tik Tok Group, Zhao Mihang, head of strategic cooperation of Risk compliance of Dow Jones China, Liu Zongyuan, General manager of North District of Feishu Commercial, Tong Jia, General Counsel of Li Ning (China) Sporting Goods Co., Ltd. held a roundtable discussion on "How AI can help Chinese enterprises deal with legal needs"; In the third session, Liu Jingdong, Director of the International Economic Law Department of the Institute of International Law of the Chinese Academy of Social Sciences, Vice president of the China Arbitration Law Society and Vice president of the WTO Law Society of the China Law Society, gave a keynote speech on the theme of "New Development of the Belt and Road International Commercial Dispute Resolution Mechanism"; The fourth session was chaired by Meng Bing, Director of the Management Committee of Allen & Overy Law Firm, holding a roundtable discussion on "How Chinese and foreign lawyers can cooperate to serve Chinese enterprises going overseas", with participation of Mao Huigang, Deputy Director of Arbitration and Lawyer Mediation Professional Committee of All-China Lawyers' Association, Director of Arbitration Research Committee in Shanghai Lawyers Association, Director of Jinmao Law Firm, Liu Xin, Partner of Freshfields Bruckhaus Deringer LLP, Zhang Xiaofeng, Director of Beijing Executive Committee of Wanshang Tianqin Law Firm, Shi Wei, Bird & Bird Law Firm Chief Representative and Partner.

Gu Yan, Vice President of CIETAC, was invited to deliver a closing speech for the event. As Chinese enterprises are increasingly going abroad, there is a growing need to understand the legal systems of foreign countries, especially countries along the Belt and Road, and to prevent legal risks. Gu Yan introduced to everyone the publications published by CIETAC, such as "Research on the International Arbitration System of Countries along the Belt and Road", "Arbitration Research Report of Chinese Enterprises 'Going Abroad'", and "Selected Arbitration Cases of countries involved in the Belt and Road". He said that arbitration is the preferred method of dispute resolution for the parties when resolving foreign-related disputes. From the perspective of the international arbitration institutions selected by Chinese enterprises in foreign-related arbitration, the top three most frequently selected by enterprises are CIETAC, HKIAC and SIAC. However, because of the lack of bargaining powerin negotiations, whether Chinese enterprises can really choose their favorite arbitration institutions, including the application of Chinese laws and the use of Chinese as the arbitration language, the reality is not so optimistic. He suggested that Chinese enterprises should grow rapidly, understand and be familiar with international arbitration rules and practices, attach importance to the conclusion of contract arbitration clauses, and strive to enter into more favorable arbitration arrangements through negotiations in advance. He also said that under the wave of technology enabling, CIETAC is also vigorously developing online arbitration and intelligent arbitration, guiding parties to file online cases and court hearings online, promoting the construction of an electronic exchange platform for arbitration documents, and constantly providing more high-quality and efficient modern arbitration legal services for Chinese and foreign parties.

Allen & Overy Partner Peter Lo hosted the event. The seminar attracted nearly 60 guests from well-known central enterprises, state-owned enterprises, media, universities and colleges to participate, the atmosphere was warm, and the conference was a complete success.
