On April 11, 2025, a lecture on “Legal Risks and Countermeasures for Enterprises Going Global”, which is one of the series of ‘Arbitration Lectures - Protecting and Benefiting Enterprises in Arbitration Practice Series Courses’, was successfully held by the Federation of Industry and Commerce of Shandong Province and organized by China International Economic and Trade Arbitration Commission (CIETAC) Shandong Sub-Commission. The series of lecture invited authoritative experts to deliver speeches on issues related to how to realise the protection and benefit of enterprises in arbitration practice, and this lecture was delivered by Xing Keke, an arbitrator of CIETAC and partner of Yuanhe Law Firm , and presided over by Zhang Yang, Secretary of the Party Branch  of Liaison Office  in Federation of Industry and Commerce of Shandong Province and Level II Division Rank Official .

 

 

Xing Keke firstly reviewed the process of Chinese enterprises going global from the perspectives of commodities, production and capital, and then pointed out the four critical steps of legal risk prevention for enterprises going global with practical experience. Meanwhile, he emphasized that enterprises should conduct thorough on-site investigations to fully understand the political, economic, and legal environment of target investment destinations. Besides, he advised enterprises to prioritize pre-investment compliance by establishing a robust internal compliance system; He also stressed that enterprises should proactively plan their intellectual property strategies, focusing on trademarks and patents, clarifying the timing, regions, channels, and details of the layout. Lastly, he highlighted the importance of prudently selecting appropriate dispute resolution mechanisms, including the arbitration institution, seat of arbitration, and applicable procedures, in accordance with the enterprise’s unique circumstances. Through the analysis of various cases, Xing Keke enabled corporate representatives to gain profound insights and equipped them with practical guidance.

 

 

After Xing Keke’s speech, the lecture transitioned into an interactive Q&A session. Xing Keke addressed legal issues encountered by corporate representatives in their practical operations and provided supplementary guidance on key considerations when drafting arbitration clauses. The event concluded amid warm applause. More than 40 corporate representatives from diverse sectors across Shandong Province and other regions attended the lecture in person and actively participated in the discussions.

The event provided enterprises with a high-quality platform for learning and interacting with each other, enabling corporate representatives to gain a more comprehensive and in-depth understanding of the legal risks associated with going global, and equipping them with effective strategies to address these challenges. The lecture concluded successfully.
