28 November 2018 to 2 December 2018, Vice Chairman and Secretary-General of CIETAC Wang Chengjie leading CITEAC delegation attended the Cross-Strait Arbitrators Training Program. During their visit to Taiwan, CIETAC and Chinese Arbitration Association, Taipei (CAA) co-organized 2018 Cross-Strait Arbitrators Training Program. Nearly 50 cross-strait arbitrators and legal practitioners participated in this training.

Mr. Li Fudian, CAA Chairperson, extended his warm welcome to Secretary-General Wang Chengjie and the delegation. Both sides reviewed the history of cooperation between two arbitration institutions and appreciated that they have achieved practical results since the cross-strait exchange activities commenced in 2001. They hoped that two sides shall deepen cooperation, strengthen the training of cross-strait arbitrators, build a platform for cross-strait arbitration’s exchange of legal and arbitral experience,, and provide arbitration services for cross-strait economic and trade dispute resolution.

During the training, Mr. Liao Yinan, adjunct-Professor (the Law School of National Taiwan University), first spoke on “The difference between the Equitable Judgement and Civil law principles, Change of circumstances, Principle of Good Faith, and Discretionary Deduction on Liquidation damages”. He pointed out that the principle of good faith, the principle of change of circumstances and the deduction of liquidated damages are important guidelines to balance the interests of the parties. The proper application of such principles by judges or arbitrators will help to achieve a fair and reasonable settlement of dispute. 

Later, Professor Li Nianzu, CAA Honorary Chairman, presented on the topic "Identification of the Applicable Law and Arbitration involved Foreign Element – ‘must-know’ of being an international arbitration lawyer” . Li first introduced the essence, precondition and test of identifying the applicable law. Secondly, he explained the matters which foreign arbitration lawyers should pay attention to. He also briefed on   ethics of international arbitration lawyers/arbitrators and their duties and responsibilities. 

Finally, Judge Zheng Jiefu from Taiwan took the title of "Recognition of Arbitral Awards and Service of Arbitration Documents in Mainland China" as the topic, introduced the legal basis for mutual recognition of civil judgments and arbitral awards between Mainland China and Taiwan, as well as the differences between arbitration and litigation, and the cross-strait service of documents of arbitral proceedings.

During the training activities, the cross-strait arbitrators seriously considered concerned issue, actively spoke, and exchanged their views. The atmosphere of the training program is active. This Program deepened mainland arbitrator’s understanding on both theory and practice of Taiwan arbitration and law. It promoted pragmatic exchanges between the cross-strait arbitration legal circles, and will play a positive role in protecting the legitimate rights and interests of the parties.
